AN APPLICATION ON BEHALF MS. _________, OWNER OF THE ALLEGED VEHICLE ____________, SEEKING PERMISSION TO APPLY FOR TRANSFER OF THE REGISTRATION OF THE ALLEGED VEHICLE FROM UTTAR PRADESH TO THE NATIVE STATE i.e. BIHAR

Most respectfully showeth:

1. That the present case is pending adjudication before this Hon’ble Court and is at the stage of Prosecution Evidence in which the next date of hearing is fixed for _______.2025 for the part cross examination of the PW-5 i.e. SI _________ and cross examination of SI ___________.
2. That the present application has been preferred by Mrs. _____________ i.e. applicant herein as well as owner of the alleged vehicle, which make is _______ Amaze, CAR(_____) DIESEL, having registration no.
3. That the alleged vehicle is released on Superdari vide order dated __________2015 passed by this Hon’ble Court.
4. That the registration date of the aforesaid alleged vehicle is _________.2014. The alleged vehicle is more than 10 years old.
5. That Hon’ble National Green Tribunal (NGT), Delhi, vide its order dated _________2014 passed in O.A. No. _______of 2014 Vardhaman Kaushik & Ors V/s UOI & Ors, has banned all vehicles that are more than 15 years of age to ply in NCT of Delhiand in case of Diesel Vehicle the time is of only 10 years. Thus, the alleged vehicle is not in use since _____________.2014 after completing 10 years.
6. That the applicant belongs to Bihar and she wants to apply for transfer of the registration certificate of the alleged vehicle in her native state i.e. Bihar where the Diesel vehicle which is more than 10 years old may be considered for the re-registration of further 5 years subject to condition of clearance of fitness test.
7. That the applicant is native of Bihar and currently working in Canada. The applicant has come to India on………… and she is in India till 2_________ 2025. The applicant wants to apply for transfer of the registration certificate of the alleged vehicle from Uttar Pradesh to Bihar.
8. That the photograph and mechanical expert report of the alleged vehicle are already filed by the Prosecution on record.
9. That the present application is a bona-fide one and no inconvenience shall be caused to the prosecution if this application is allowed in favour of the applicant.

PRAYER

        It is, therefore, most respectfully prayed that under the aforesaid facts and circumstances this Hon’ble court may kindly be pleased to:

1. Allow the present application of the applicant and grant permission to get the transfer of registration certificate of the alleged vehicle i.e. ____________ from Uttar Pradesh to Bihar,
2. Pass any other order which this Hon’ble court may deem fit and proper, in the interest of justice.
