Legal Light Consulting: Know What NHRC Will Not Entertain — A Guide for NRIs and Citizens

Filing a Human Rights Complaint? Understand the Boundaries First

At Legal Light Consulting (LLC), we believe that informed action is the first step toward justice. While the National Human Rights Commission (NHRC) of India offers a vital platform for redress against violations of dignity, liberty, and equality, not every grievance qualifies for its intervention.

Before filing a complaint, it’s essential to understand what the NHRC does not ordinarily entertain. This helps avoid delays, rejections, and misdirected efforts—especially for NRIs navigating legal systems from abroad.

Types of Complaints NHRC Typically Rejects

Here’s a breakdown of complaints that fall outside NHRC’s purview:

Delayed Complaints

  • Incidents that occurred more than one year before the date of filing are usually not accepted.

Sub-Judice Matters

  • If your issue is already under consideration by a court of law or another National/State Commission (such as a State Human Rights Commission), NHRC will not intervene.

Vague or Anonymous Complaints

  • Complaints that are anonymous, pseudonymous, or frivolous, and those lacking clear evidence of a human rights violation, are dismissed.

Service-Related Grievances

  • NHRC does not entertain service matters, except those related to:
    • Pension or family pension
    • Retirement benefits
    • Denial of wages Other employment-related disputes fall outside its scope.

Civil and Family Disputes

  • Issues involving property disputes, matrimonial conflicts, or other civil matters are not considered human rights violations and are better addressed through civil courts or family law channels.

Filing a Valid Complaint: What You Need

If your issue qualifies, filing with NHRC is straightforward and free of charge. Your complaint should include:

  • Date and place of the incident
  •  Nature of the alleged violation
  •  Name of the public authority involved (if applicable)
  •  Full contact details, name, and signature of the complainant

 Submission Options:

  • By Post: National Human Rights Commission Manav Adhikar Bhawan, Block-C, GPO Complex, INA, New Delhi – 110023
