Alternative Dispute Resolution in India – Legal Light Consulting
In today’s fast-paced world, the demand for quick, cost-effective, and amicable resolution of disputes is more urgent than ever. At Legal Light Consulting, we recognize that traditional litigation—while essential in some cases—often leads to delays, rising costs, and emotional strain.
That’s why we champion the use of Alternative Dispute Resolution (ADR) mechanisms such as arbitration, conciliation, and mediation, offering our clients smarter, faster, and more collaborative legal solutions.
Why ADR Matters
ADR is not just a legal tool—it’s a strategic approach to resolving disputes without the adversarial nature of courtroom battles. Whether you’re a business seeking contract enforcement or an individual navigating a family or property dispute, ADR offers:
- Speedier resolution
- Lower legal costs
- Confidential proceedings
- Preservation of relationships
- Greater control over outcomes
ADR is especially valuable in commercial, matrimonial, property, and cross-border disputes, where time and discretion are critical.
Arbitration in India – A Legal Evolution
Arbitration is one of the most structured forms of ADR, governed by the Arbitration and Conciliation Act, 1996. This Act was enacted to align Indian arbitration law with global standards, particularly the UNCITRAL Model Law on International Commercial Arbitration (1985).
Key Features of the Act:
- Minimizes court intervention
- Enables time-bound and cost-efficient proceedings
- Applies to both domestic and international commercial disputes
- Allows arbitrators to facilitate settlement through mediation or conciliation
- Treats arbitral awards as enforceable court decrees
The Act is divided into four parts:
- Part I: Arbitration
- Part II: Enforcement of Foreign Awards
- Part III: Conciliation
- Part IV: Supplementary Provisions
It also includes seven schedules detailing procedures, qualifications, and ethical standards.
Amendments for Efficiency
To make arbitration more robust and investor-friendly, the Act was amended in 2015 and 2019, introducing:
- Defined grounds for challenging arbitrators
- Time-bound completion of arbitration (12 months, extendable by 6 months)
- Interim relief provisions to protect assets during proceedings
- Limited scope for challenging arbitral awards
- Removal of automatic stay on enforcement of awards
- Proposal for an Arbitration Council of India (ACI) to grade arbitral institutions
India International Arbitration Centre Act, 2019
This Act established the India International Arbitration Centre (IIAC), a national institution designed to:
- Provide administrative support for arbitration, mediation, and conciliation
- Maintain panels of accredited professionals
- Promote research, training, and conferences in ADR
- Position India as a global hub for institutional arbitration
Mediation – A Human-Centered Approach
Mediation is a voluntary, informal process that encourages parties to negotiate and reach a mutually acceptable solution. Unlike arbitration, mediation preserves relationships and fosters collaboration.
However, mediation in India has lacked formal structure and legal recognition—until now.
The Mediation Bill, 2021
Introduced in the Rajya Sabha, the Mediation Bill, 2021 aims to:
- Create a consolidated legal framework for mediation
- Encourage voluntary and court-referred mediation
- Recognize mediated settlements under law
- Promote private and institutional mediation across sectors
The bill is currently under review by a Joint Parliamentary Committee, with recommendations under active consideration by the government.
