THE HUMBLE PETITION OF

THE APPLICANTS ABOVE NAMED

MOST RESPECTFULLY SHOWETH:

  1. That the present Special Leave Petition is being preferred by the Petitioner herein against the impugned Judgment and final Order dated 02.05.2022 passed by the Hon’ble High Court of Delhi at New Delhi in Writ Petition (C) No. ___of 2019 filed by the Respondents herein whereby the Hon’ble High Court completely ignored the report on meeting conducted with representative of major stakeholders and the representatives of recruitment agencies on02/05/2024 on preparation and operation of Reserve Waiting List in compliance of order dated 21___2024 and erroneously directed the Petitioner to prepare a Reserve Panel/Wait List of candidates taking into consideration the result already declared on 28.08.2017.
  2. That the facts and circumstances stated in the abovementioned Special Leave Petition may be taken as part and parcel of this application and the same is not being repeated herein for the sake of brevity.
  3. That the impugned order was passed on 10.01.2019 by the Hon’ble High Court of Orissa, Cuttack, in W.P. (C) No. ______of 2024. Thereafter the certified copy of the impugned order was applied for on 18.1.2019, which was delivered on 2.4.2019. Thereafter necessary legal consultation was done and the opinion of the Law Department was obtained.
  4. That after obtaining the said opinion the matter was further discussed at various levels and finally as per the advice of the Chief Secretary, Odisha the meeting of the Departmental Empowered Committee was held on ____________ under the Chairmanship of Special Secretary to Govt. in DoWR and it was decided to file a special leave petition before this Hon’ble Court.
  5. That accordingly Law Department, Govt. of Odisha vide memo No _____dated ____.2019 once again communicated regarding filing of SLP. That on ____2019, Secretary to Govt. in DoWR Odisha Bhubaneswar authorized the Executive Engineer M.I. Division, ______to file SLP before this Hon’ble Court.Thereafter the concerned officer, proceeded to Delhi on______2019 with relevant records of the case, and the special leave petition was prepared. That, since some more documents were required for filing of thepetition,the same was called for and incorporated into the Petition.
  6. Thus the process of consultation, arrangement of documents, and preparation of the Special Leave Petition took some time and led to this delay in the filing of the present petition. That the delay so caused is neither deliberate nor intentional and as such may kindly be condoned in the interest of justice.
  7. That the interest of justice would be served, if the delay caused in filing the present Special Leave Petition is being condoned and the matter is decided on merits.
PRAYER

It is therefore, most respectfully prayed that this Hon’ble Court may be pleased to:

  1. Condone the delay in filing the Special Leave Petition against the Impugned judgment and final order dated 02.05.2022 passed by the Hon’ble High Court of  Delhi at New Delhi in Writ petition (C)No. _____/2019; and
  2. Pass any other or further orders as may be deemed fit and proper in the circumstances of the case.
