Application for exemption from filing officially translated documents with the Supreme Court of India
Special Leave Petitions: A Glimpse Into Supreme Court Proceedings
The Supreme Court of India serves as the apex authority for dispensing justice and upholding the Constitution.
The procedural nuances of filing petitions and applications in the Supreme Court are critical for litigants seeking redressal. One such document, an application for exemption from filing official translated copies of annexures, provides a window into the meticulous legal processes involved.
Understanding the Context
In a case titled “ABCD vs. Union of India & Ors.,” the petitioner has approached the Supreme Court under Article 136 of the Constitution.
This article grants the Supreme Court the discretionary power to allow appeals from any court or tribunal within India.
The case highlights an appeal against a Bombay High Court judgment that reversed a tribunal’s decision in favor of the petitioner, resulting in the termination of the petitioner from a teaching post.
The petitioner alleges that their termination was a result of exposing irregularities and mismanagement in the school’s administration. The petitioner also cites adverse remarks in their confidential report following the whistleblowing.
The Core Application
In the Special Leave Petition (SLP), the petitioner filed an application seeking exemption from submitting official translated copies of annexures marked as P-4 and P-5.
These documents were originally in the vernacular language, and translations were prepared due to time constraints. The petitioner requests the Court to accept these unofficial translations, arguing that the matter’s urgency necessitated this step.
Legal Procedure and Relevance
This application underscores a crucial aspect of legal proceedings—adherence to procedural requirements while addressing practical challenges.
Annexures like P-4 and P-5 are critical evidence supporting the petitioner’s claims. The application serves as a formal request to the Court, emphasizing that justice should not be delayed or denied due to procedural technicalities.
The petitioner prays for the following reliefs:
- Permission to bring the translations of Annexures P-4 and P-5 on record.
- Any other order deemed appropriate by the Hon’ble Court.
Role of Legal Professionals
Navigating such complex processes requires expertise. Legal professionals play an indispensable role in ensuring that petitions, annexures, and accompanying applications meet the stringent requirements of the judiciary.
