Types of Complaints Not Entertained by NHRC

The Commission generally does not accept the following:

1. Delayed Complaints

  • Incidents that took place more than one year before the filing of the complaint.

  • Issues already pending before a court of law, a State Human Rights Commission, or another statutory authority.

  • This ensures there is no duplication of proceedings.

3. Vague or Frivolous Complaints

  • Complaints that are anonymous, pseudonymous, vague, or frivolous, with no clear evidence of a human rights violation.

4. Service-Related Complaints

  • Service matters such as promotions, transfers, and employment disputes.

  • Only exceptions include pension, family pension, retirement benefits, or denial of wages.

5. Civil & Property Disputes

  • The NHRC does not handle property disputes, matrimonial issues, or family disagreements, as these fall under the jurisdiction of civil courts.

How to File a Valid Complaint

Even though there are restrictions, the NHRC has made the filing process simple and accessible:

  • No Fee Charged: Filing a complaint with the NHRC is completely free.

  • Format: A complaint can be written on plain paper, with the following details:

    • Date and place of incident

    • Nature of the alleged violation

    • Name of the public authority (if any) involved

    • Full contact details of the complainant (with name and signature)
