Defining Goods, Defects, and Services in India
Who is Not a Consumer?
While the Consumer Protection Act, 1986, provides broad protection to consumers, there are specific instances where individuals may not be considered consumers:
- Free Goods or Services: Individuals who receive goods or services free of charge are not considered consumers.
- Commercial Purchases: If a person purchases goods or services for commercial purposes, they are not considered consumers under the Act.
- Contract of Service: Individuals who avail of services under a contract of personal service, such as domestic help or personal care services, are not covered.
Defining Goods, Defects, and Services
- Goods: Any movable property, other than money and actionable claims, falls under the definition of goods. This includes tangible items like electronic gadgets, clothing, and food products.
- Defects: A defect refers to any fault, imperfection, or shortcoming in the quality, quantity, potency, purity, or standard of a product. It can also refer to a deviation from the claims made by the seller or manufacturer.
