1. What is a Transfer Petition in the Supreme Court of India?

A Transfer Petition is an application filed before the Supreme Court seeking transfer of a case (civil, criminal, or matrimonial) from one State/High Court to another State/High Court, or from one court to another within the same State, or even to the Supreme Court itself. Legal Provisions:

  • Civil cases → Section 25 CPC & Article 139A Constitution
  • Criminal cases → Section 406 CrPC
  • Multiple related cases → Article 139A

2. Who can file a Transfer Petition?

Any party to the case (petitioner or respondent), the Attorney General, or even the Supreme Court can suo-moto transfer. Most commonly filed by wives in matrimonial/498A cases.

3. What are the most common grounds for transfer accepted by the Supreme Court?

  • Inconvenience & hardship to a party (especially women, children, elderly)
  • Threat to life/safety in the current state
  • Apprehension of bias or lack of fair trial
  • Convenience of witnesses
  • Ends of justice
  • Conflicting judgments in related cases

4. Can matrimonial/divorce/498A/DV cases be transferred?

Yes. These are the MOST transferred cases. Supreme Court very liberally transfers cases filed by husbands in their home state to the wife’s current place of residence (especially when minor children are involved).

5. How to file a Transfer Petition in Supreme Court?

  • File under original jurisdiction (Transfer Petition (Civil) or (Criminal))
  • E-filing is mandatory via Supreme Court portal
  • File along with affidavit, synopsis, certified copies of orders, and proof of hardship
  • Court fee: ₹5,000–₹10,000 (depending on civil/criminal) + ₹250 per additional respondent

6. Is there a prescribed format for Transfer Petition?

Yes. It must contain:

  • Index, Synopsis & List of Dates
  • Grounds with specific instances of hardship
  • Prayer for transfer + interim stay

7. Can the husband oppose the wife’s Transfer Petition?

Yes. He must file a Counter-Affidavit within the time granted (usually 2–4 weeks). Most oppositions fail unless the wife is proved to be misusing the process.

8. Will the lower court proceedings be automatically stayed?

No automatic stay. You must specifically pray for interim stay. Supreme Court usually grants stay on the very first hearing in genuine cases.

9. How long does it take for a Transfer Petition to be decided?

  • Urgent matters (especially women’s cases): 1–8 weeks
  • Normal matters: 3–12 months
  • Can be listed urgently by mentioning before the Registrar or Chamber Judge

10. Can video conferencing be a ground to refuse transfer?

Earlier yes (Krishna Veni Nagam judgment, 2017), but post-2020, the Supreme Court has held that mere availability of VC is NOT sufficient to deny transfer when genuine hardship or safety issues exist (latest 2024–2025 orders).

11. Can a case be transferred after trial has started or evidence is over?

Yes, but the Supreme Court scrutinizes belated petitions strictly. Transfer is still allowed if strong grounds exist (threat, bias, etc.).

12. What documents are required?

  • Certified copy of the case & impugned order
  • All previous court orders
  • Proof of residence (Aadhaar, passport, etc.)
  • Evidence of hardship/threat (if any)
  • Vakalatnama & affidavit

13. What happens if the Transfer Petition is allowed?

The case is transferred to the desired court + proceedings in the original court are stayed + cost may be imposed on the opposite party in appropriate cases.

14. Can costs be imposed if the petition is frivolous?

Yes. Supreme Court regularly imposes ₹25,000–₹1 lakh costs for false or malafide transfer petitions.

15. Latest Supreme Court trend (2024–2025) in matrimonial transfers?

  • Strong inclination to transfer the case to the wife’s place of residence
  • Threat perception of women taken very seriously
  • Minor children’s convenience given top priority
  • Husband’s “forum shopping” strongly discouraged
