Look-Out-Circular (LOC) in NRI Matrimonial Disputes

Look-Out-Circular (LOC) in NRI Matrimonial Disputes: Essential Support for NRIs in India – Guidance from Legal Light Consulting

Non-Resident Indians (NRIs) and Persons of Indian Origin (PIOs) often face unique challenges in matrimonial disputes, particularly when one spouse evades legal proceedings by fleeing abroad.

In such cases, tools like the Look-Out-Circular (LOC) and Interpol notices play a crucial role in preventing the accused from leaving or entering India and facilitating international cooperation.

Legal Light Consulting, a premier law firm in Delhi specializing in NRI legal services, provides comprehensive support to help NRIs navigate these mechanisms.

This educational article, based on guidelines from the Ministry of Home Affairs (MHA) and the Ministry of External Affairs (MEA), details the categories of cases for issuing an LOC, the required procedures, and the types of Interpol notices.

What is a Look-Out-Circular (LOC)?

A Look-Out-Circular (LOC) is a directive issued by Indian authorities to immigration officials at airports, seaports, and land borders to monitor and restrict the movement of individuals involved in criminal cases.

In the context of NRI matrimonial disputes, an LOC is often sought against overseas husbands accused of offences like cruelty (Section 498A IPC), dowry harassment, or desertion, to prevent them from evading arrest or trial.

It acts as a coercive measure to compel the accused to surrender to investigating agencies or courts. LOCs are not arrest warrants but alert mechanisms that can lead to detention or denial of entry/exit.

Legal Light Consulting assists NRIs, especially deserted wives, in approaching senior police authorities or courts to initiate LOC proceedings, ensuring compliance with legal protocols.

Categories of Cases for Issuing an LOC and Circumstances

An LOC can be issued in specific categories of cases involving cognizable offences under the Indian Penal Code (IPC) or other penal laws. In NRI matrimonial disputes, this typically applies when:

  • The overseas husband is deliberately evading arrest or not appearing in court despite the issuance of Non-Bailable Warrants (NBWs) and other coercive measures.

  • There is a likelihood that the accused will leave the country to evade trial or arrest.

Examples of qualifying offences in NRI cases include:

  • Cruelty and domestic violence (Section 498A IPC).

  • Criminal breach of trust, such as withholding streedhan (Section 406 IPC).

  • Cheating or fraud in marriage (Section 420 IPC).

  • Dowry-related offences under the Dowry Prohibition Act, 1961.

LOCs are not issued for minor or civil disputes but only for serious penal offences where the accused poses a flight risk.

The subordinate courts have jurisdiction to affirm or cancel an LOC, similar to their authority over NBWs.

At Legal Light Consulting, we evaluate your case to determine if it qualifies for an LOC, helping file complaints under relevant IPC sections and coordinating with investigating agencies to request issuance.

Procedure for Issuing a Look-Out-Circular

The procedure for opening an LOC is stringent to prevent misuse, as outlined in the MHA’s 2010 Memorandum and subsequent guidelines.  It involves the following steps:

Initiation by Investigating Officer (IO)

The IO must make a written request for an LOC to the designated officer (as notified by MHA circulars), providing detailed reasons, evidence of the offence, and justification for the LOC. This includes proof of evasion, such as ignored NBWs or attempts to flee.

Approval from Competent Authority

The request must be approved by an officer not below the rank of:

  • Deputy Secretary to the Government of India.

  • Joint Secretary in the State Government.

  • District Magistrate of the concerned district.

  • Superintendent of Police (SP) of the district.

  • SP in the Central Bureau of Investigation (CBI) or equivalent.

  • Zonal Director in the Narcotics Control Bureau (NCB) or equivalent.

  • Deputy Commissioner in the Directorate of Revenue Intelligence, Central Board of Direct Taxes, or Central Board of Excise and Customs.

  • Assistant Director of the Intelligence Bureau (IB) or Bureau of Immigration (BoI).

  • Deputy Secretary of the Research and Analysis Wing (R&AW).

  • Superintendent of Police in the National Investigation Agency (NIA).

  • Assistant Director of the Enforcement Directorate (ED).

  • Protector of Emigrants or Deputy Secretary in the Government of India.

  • Designated officer of Interpol.

The competent officer reviews the request and passes an order directing the issuance of the LOC if satisfied with the grounds.

Issuance and Circulation

Once approved, the LOC is issued by the Bureau of Immigration (BoI) and circulated to all immigration check posts in India. It can be an “open” LOC (valid indefinitely until cancelled) or time-bound.

Court Directions: LOCs can also be issued based on orders from criminal courts in India, particularly in ongoing trials where the accused

Types of Interpol Notices and Their Purposes

When an NRI spouse evades justice internationally, Interpol notices may be requested through the CBI’s Interpol wing to seek global cooperation. These notices are color-coded alerts shared among In. The types and purposes are:

Red Notice

To seek the location and arrest of wanted persons for extradition or similar lawful action. Commonly used in serious criminal cases, including some NRI matrimonial offences if they meet dual criminality criteria.

Yellow Notice

To locate missing persons, often minors, or identify individuals unable to identify themselves. Useful in child abduction cases arising from NRI disputes.

Blue Notice

To collect additional information about a person’s identity, location, or activities related to a crime. Helps gather evidence in ongoing investigations.

Black Notice

To seek information on unidentified bodies, aiding in closure for families in suspicious deaths linked to disputes.

Green Notice

To provide warnings and intelligence about persons who have committed offences and may repeat them in other countries. Applicable to habitual offenders in cross-border fraud or abuse.

Orange Notice

To warn of an event, person, object, or process posing a serious threat to public safety, such as dangerous fugitives.

INTERPOL-United Nations Security Council Special Notice

Issued for groups or individuals targeted by UN Security Council sanctions, typically for terrorism-related activities (rare in matrimonial disputes).

Purple Notice

To seek or provide information on modus operandi, objects, devices, or concealment methods used by criminals. Helps in investigating sophisticated frauds.

Interpol notices are not international arrest warrants but facilitate cooperation. In NRI cases, a Red Notice may follow an LOC if extradition is pursued, but matrimonial disputes often lack the severity for such notices.

Legal Light Consulting coordinates with the CBI and MEA to request appropriate Interpol notices, ensuring alignment with international legal principles.

Precautions and Alternatives for NRIs

  • Document Everything: Preserve evidence of evasion, such as ignored summons or travel attempts, to strengthen LOC requests.

  • Approach Authorities Promptly: File FIRs early to initiate investigations and LOC proceedings.

  • Explore Alternatives: If LOC or extradition isn’t feasible, pursue civil remedies like the MEA’s scheme for deserted women or virtual court hearings.

  • Avoid Misuse: LOCs should not be used for private disputes; misuse can lead to legal repercussions.

Conclusion

Look-Out-Circulars and Interpol notices are vital tools for NRIs in India to address evasion in matrimonial disputes, but they apply only to serious criminal cases with proper approvals.
