Supreme Court Transfer Petition for Divorce in India
Empowering with Clarity, Strength & Results
Divorce cases in India can sometimes be complicated, especially when the spouses live in different states, cities, or even countries. In such situations, the Supreme Court of India provides a legal remedy known as a Transfer Petition (Civil), allowing a divorce case to be transferred from one court to another for convenience, safety, or fairness.
This blog explains the process, grounds, and benefits of filing a Supreme Court Transfer Petition in divorce cases, with a focus on NRI (Non-Resident Indian) divorces and inter-state matrimonial disputes.
Mutual Consent Divorce
The simplest, fastest, and most amicable way to dissolve a marriage.

Contested Divorce
Strategic litigation for cases involving cruelty, adultery, desertion, or irreconcilable differences.
Child Custody & Visitation Rights
We fiercely advocate for arrangements that serve the child’s best interests.

Grounds for Filing a Supreme Court Transfer Petition in Divorce Cases
Convenience of the spouse – Courts recognize the hardship of traveling long distances.
NRI residence abroad – Ensures the case can proceed without requiring international travel.
Child custody or welfare – Protects the best interest of minor children.
Medical or health issues – Provides easier access to the court.
Harassment or safety concerns – Protects the spouse from threats.
Employment or professional commitments – Reduces undue hardship.
The Supreme Court considers these factors carefully before granting a transfer
A Supreme Court Transfer Petition is a vital legal tool for ensuring fairness and convenience in divorce proceedings, particularly for NRIs and inter-state litigants. By filing a transfer petition, a spouse can have their case heard in a court closer to their residence, making it easier to participate fully in legal proceedings while safeguarding their rights and interests.
Legal Light Consulting specializes in Supreme Court Transfer Petitions for divorce cases, guiding clients across India and abroad through every step—from drafting the petition to ensuring successful filing and representation.

Rights
+
Contested Divorce
For cases with disagreements on grounds like cruelty, adultery, desertion (2+ years), mental illness, conversion, communicable diseases, renunciation, or irretrievable breakdown. We provide strategic litigation, evidence building, and representation from negotiation to trial. Timeline: 2-5+ years; we minimize delays.
Child Custody & Visitation Rights
Child’s welfare is paramount. We secure sole/joint/shared custody, guardianship, access/parenting time, handling parental abduction/alienation. Foreign custody orders need Indian validation if child/parent resides here. Grandparents can claim rights if in child’s best interest.
Child Support Calculation: Based on child’s needs (education, health, extracurriculars, living expenses) and parent’s global earnings. Enforceable via international treaties.
Alimony & Spousal Maintenance
Fair financial support considering marriage duration, lifestyle, earning capacity. Options: Monthly or lump sum. Indian courts enforce via asset seizure; cross-border via foreign proceedings. We help seek or contest claims.

Update: Ever since this review has been posted Mr Pandey has been personally harassing me and my sister thru phone calls, calling late night and calling us names. Now he has posted a complete fake response of me and my partner being inter caste while hiding his own inefficiency of not able to get our process completed. When I thought this person could not stoop any lower, he exceeds my expectations every single time. We booked Advocate Pandey months in advance for an NRI wedding, trusting his assurances that all timelines would be met. He was polite at first and confidently promised everything would be ready, to the point where we booked our flights based on his commitment. As the date approached, communication broke down. He stopped replying to messages and would only answer sporadically. Worse, on several occasions when my female family members tried to speak with him, he made blatantly misogynistic remarks like, “Ask your husband or brother to call me.” This was not a one-off—he repeatedly refused to communicate directly with women in my family. Even towards the end of our trip, he kept promising, “It will be done tomorrow,” but tomorrow never came. At one point, he told us to gather at the courthouse, which led to elderly in-laws flying in from another city. When we arrived, he was unable to proceed with anything. It was deeply embarrassing for us in front of our families. When my partner asked for a refund of our booking fee, he again refused to speak to her directly, saying her husband should call instead. This is unacceptable in any professional service, let alone from someone in the legal profession. I strongly advise against using Mr. Pandey’s services. Read the other low-star reviews—our experience matches them. Don’t be misled by what appear to be fake positive reviews online. We left India with nothing resolved and a lot of wasted time, money, and frustration.Posted on Arun DhamijaTrustindex verifies that the original source of the review is Google. Terrible Experience – Completely Unprofessional! I had a truly awful experience with Legal Light Consulting and Advocate Vikas Pandey. What should’ve been a simple legal matter turned into a nightmare thanks to their total lack of professionalism. Endless delays: They missed deadlines, ignored emails, and rarely answered calls. I had to chase them constantly just to get basic updates. Poor legal guidance: The advice was vague, generic, and clearly rushed. It felt like they didn’t even try to understand my case properly. Took ₹40,000 and delivered nothing: I paid ₹40,000 in good faith, expecting proper legal help. Instead, I got excuses, delays, and zero results. To make things worse, they later added hidden fees with no clear explanation. This is not how any legal professional should operate. I deeply regret trusting them. If you value your money and sanity, avoid Legal Light Consulting and Advocate Vikas Pandey at all costs.Verified by TrustindexTrustindex verified badge is the Universal Symbol of Trust.
