1. Filing the Petition

After filing, the court issues a public notice in newspapers for a period of 45 days. During this time, anyone with objections can contest the claim. If no objections are received, the court proceeds to issue the certificate.

4. Issuance of Succession Certificate

In most cases, the process takes 3 to 4 months from the date of filing. However, if objections are raised, it may take longer—generally around five to seven months.

Jurisdiction of the Court

The District Judge has the authority to issue a succession certificate:

  • In the district where the deceased ordinarily resided at the time of death, or

  • If no fixed place of residence, in the jurisdiction where any part of the deceased’s property is located.
