Where to File a Consumer Complaint in India
The Consumer Protection Act, 1986, has established a three-tier system of consumer redressal forums to handle consumer complaints efficiently. The appropriate forum for filing a complaint depends on the value of the claim.
1. District Forum:
- Jurisdiction: Handles complaints where the value of the claim is up to ₹20 lakh.
- Composition: Consists of a President (a judicial officer) and two other members, one of whom must be a woman.
2. State Commission:
- Jurisdiction: Handles complaints where the value of the claim is between ₹20 lakh and ₹1 crore. Also hears appeals against the orders of District Forums.
- Composition: Consists of a President (a retired High Court judge) and two other members.
3. National Consumer Disputes Redressal Commission (NCDRC):
- Jurisdiction: Handles complaints where the value of the claim exceeds ₹1 crore. Also hears appeals against the orders of State Commissions.
- Composition: Consists of a President (a retired Supreme Court judge) and other judicial and non-judicial members.
