NCLT Benches: The Central Government has constituted National Company Law Tribunal (NCLT) under section 408 of the Companies Act, 2013 (18 of 2013) w.e.f. 0106.2016.

In the first phase the Ministry of Corporate Affairs has set up eleven Benches, one Principal Bench in New Delhi and one each Regional Bench in New Delhi, Ahmedabad, Allahabad, Bengaluru, Chandigarh, Chennai, Guwahati, Hyderabad, Kolkata and Mumbai.

Primarily we practice in New Delhi, but we used to appear before all NCLTs across the country.

Before the NCLT & NCLAT following kinds of cases/appeals/petitions and applications are generally filed, under the New Companies Act, 2013:

  • An application under section 2(41) of the Companies Act, 2013 for change in a financial year.
  • An application under section 7(7) of the Companies Act, 2013 to the Tribunal where the company has been incorporated by furnishing false or incorrect info or by any fraudulent action.
  • An application under section 14(1) of the Companies Act, 2013 for the conversion of a public company into a private company.
  • An application under section 55(3) of the Companies Act, 2013 for the issue of further redeemable preference shares.
